Q: Do I need to claim accident in company vehicle with my insurance company?
I want to get new insurance but I was in an accident in a company vehicle. I got the ticket, but the company's insurance paid the claim. My personal insurance wasn't affected. Do I have to tell my insurance co about the accident? With my current insurance I did. But my premiums are outrageous!

A: although the company's insurance paid the claim, YOU had the accident and YOU got the ticket. therefore, YOUR insurance will go up as YOU now have points on your record for the ticket and accident. you do not need to make a CLAIM on your policy, but your record reflects these points for the next 3 yrs and it will affect your personal policy premium.

I was in a accident today and if my car is considered total and the insurance company cuts me a check for what they think its worth, can I also keep my vehicle in addition to the insurance check. A: When an insurance company total losses the vehicle - they buy it from you. Then they sell the vehicle for parts at a salvage auction to try and recover some of what they paid.
If you want to keep the vehicle- the insurance company will subtract what they think they can get for the vehicle at auction. You get the car and the difference. You do not get full value and the car. Usually you get about 75% of the car's value and the car when your retain the salvage.

To actually answer your question I believe the insurance settlement becomes part of your assets to be used by the bankruptcy court to settle your debts. Ask the attorney that represented you in court to be sure. The court would not be pleased if you spent the funds without authorization.

I have to pay out of pocket for another persons car that I damaged.

I hit a cow one night at 60 mph. The issue of fault on the ranchers part was never in question and the rancher was in agreement about it being his fault. Ultimately, their insurance company offered me a settlement in which I did not agree with in the beginning. A week later they called back and gave me another settlement offer in which I did accept. I received the check and it is not what the agent quoted me so I called him and he told me that the quote he gave me was for the vehicle, rental replacement vehicle, tow fee, and some other fee. I did not have to pay a tow fee. Basically, he included it in my final payout but did not break it down and tell me that it was being included. I had to go get another vehicle so I let them know that as soon as I got the insurance check I would bring it in to them for the down payment on it. So ultimately I got 500 less than what he quoted me on the phone. What I am wanting to know is if I cash this check does that mean that I'm in compliance?
A: Yeah, if you cash the check you are definately in compliance. But, if you had a verbal agreement or if you already signed something you may already be in compliance anyway. Don't cash the check yet and don't return it yet either.
This sounds like your first accident and the strategy that the insurance company used here is not uncommon with people who have first accidents. If you are insured, then your insurance carrier should have automatic coverage for hitting an animal ( I think it's called "Other Than Collision" coverage). I didn't quite understand who's insurance company is paying you, but I would call your own insurance company to see what they can do.
If it turns out that you cannot get any further, then go ahead and cash the check. This one, you might have to chalk up to experience at a cost of $500. The check should have about 60 days before it expires so try the other avenues first.

If the loss just occured w/ in the last week, I can see how maybe it has taken a little longer to inspect your vehicle (remember we've had 2 holidays in the past week, christmas and new years)
Otherwise it should be no more than about 3 working days for someone to inspect your car.
As far as how long until you are paid for the damages....... If there are no issues with the claim and they accept full liability, you should expect a check within a week or so after the inspection of your car.
If the adjuster is not returning you calls, call the 800# for the company and get the operator on the line, then ask to speak with the supervisor for your adjuster.

A: Well, it's based on the "salvage" value of the car - what a junk yard would buy it back from them at. Normally, it's $750 to $2,000, depending on the make, model, and how many decent body parts you have left.
Yes, you can keep the car . . . they would subtract the salvage value from the total paid out. You'd still have to turn in the title, and they'd get a salvage title issued to you.
You negotiate keeping the car, before the claim is settled. Once they've taken the car from you, you can't actually recover it - it probably goes straight to the junk yard, and the parts start coming off.
