Q: Funny outrageouse people suing companies for a dumb reason?
The “Stella Awards” are named after the 81-year-old woman, Stella Liebeck, who spilled hot coffee on herself and success-fully sued McDonald’s in New Mexico for 2.9 million dollars. Ever since, the name “Stella Award” has been applied to any wild, outrageous, or ridiculous lawsuits - including bogus cases! Here are this year’s winners…
7th Place - Kathleen Robertson of Austin, Texas, was awarded $80,000 by a jury of her peers after breaking her ankle when she tripped over a toddler who was running inside a furniture store. The owners of the store were understandably surprised at the verdict, considering that the misbehaving little toddler was Ms. Robertson’s son.
6th Place - Nineteen-year- old Carl Truman of Los Angeles won $74,000 and medical expenses when his neighbor ran over his hand with a Honda Accord. Mr. Truman apparently didn’t notice there was someone at the wheel of the car when he was trying to steal his neighbor’s hubcaps.
5th Place - Terrence Dickson of Bristol, Pennsylvania, was leaving a house he had just finished robbing by way of the garage. He was not able to get the garage door to go up since the automatic door opener was malfunctioning. He couldn’t re-enter the house because the door connecting the house and garage locked when he pulled it shut. The family was on vacation, so Mr. Dickson found himself locked in the garage for eight days. He subsisted on a case of Pepsi he found, and a large bag of dry dog food. He sued the home owners’ insurance company, claiming the situation caused him undue mental anguish. The jury agreed to the tune of $500,000. In my opinion, this is SO outrageous that it should have been 2nd Place.
4th Place - Jerry Williams of Little Rock, Arkansas, was awarded $14,500 and medical expenses after being bitten on the buttocks by his next-door neighbor’s beagle. The beagle was on a chain in its owners’ fenced yard. The award was less than originally sought, because the jury felt that the dog might have been just a little provoked at the time by Mr. Williams who had climbed over the fence into the yard and was shooting it repeatedly with a pellet gun.
3rd Place - A Philadelphia restaurant was ordered to pay Amber Carson of Lancaster, Pennsylvania, $113,500 after she slipped on a soft drink and broke her coccyx (tail bone). The beverage was on the floor because Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument.
2nd Place - Kara Walton of Claymont, Delaware, successfully sued the owner of a night club in a neighboring city when she fell from the bathroom window to the floor and knocked out her two front teeth. This occurred while Ms. Walton was trying to sneak through the window in the ladies’ room to avoid paying the $3.50 cover charge. She was awarded $12,000 and dental expenses.
1st Place (drum roll, please) - This year’s runaway winner was Mrs. Merv Grazinski of Oklahoma City, Oklahoma. Mrs. Grazinski purchased a brand-new, 32-foot-long Winnebago motor home. On her first trip home from an OU football game - having driven onto the freeway - she set the cruise control at 70 mph and calmly left the driver’s seat to go into the back to make herself a sandwich. Not surprisingly, the RV left the freeway, crashed and overturned. Mrs.Grazinski sued Winnebago for not advising her in the owner’s manual that she couldn’t actually do that. The jury awarded her $1,750,000 plus a new motor home. The company actually changed its manuals on the basis of this law suit, just in case there were any other complete morons around.
A: How does it feel to post something that was debunked six years ago? If I did it, and it was pointed out in front of everyone, I'd feel pretty stupid.
Limestoner62, and anyone else who missed it, and whoever gave me the thumbs down if it was someone else, nobody paid out a dime in any of these cases, as none of these cases actually happened. They're all made up. Not true. Lies. Phonies. False. Mythical. I'm not sure how else to say it. They didn't happen!!!
Q: I need an insurance company.....?
...that will insure a RV as if it were a home with an occupant. We own a RV that my father in-law lives in. He can't work so, all we could afford to do at the time was to purchase a RV and let him basically have it (kind-of we are still paying for it). Since he's living in it we need to insure it as a home with full coverage or even as a rental property if needed (including a storm and hurricane policy). We cant find a company willing to do that. All the companies we've spoken with want to insure it as a trailer and not a home...but now it is a home... We live on the Gulf Coast of Texas (north of the Galveston area) if a hurricane comes along it needs to be covered / replaced if needed and regular trailer insurance doesn't do that...
Does anyone know of a legitimate company that will?

Thanks for trying to help. I've already contacted all the companies (except the one that is ins. for those who live in the UK) and they cannot or won't insure a RV the way we need them to. They all want to insure it as a car and that isn't enough coverage, especially since it is lived in...

Q: Insurance premium increase of 50%?
I had an accident with my RV that was about $1,200.00 on my side and very minor on the other vehicle. The accident was considered my fault and being 1 point and my first ever in over 32 years of driving. My insurance company now has increased my premium about 50%. I am in California and would like to understand the criteria for this increase. It looks like the company will recover the full amount paid in the next premiums. Where can one go to understand this?

A: That's a huge increase!!I would definitely look around for a different insurance company,i mean,it being your first MINOR collision,that amount of increase just does not equate.I use State Farm,i get a discount for insuring my vehicles and home with them,check their quotes while or if you're going to look for a more compromising plan.

Q: Legal advise - my parked car was hit?
I was vacuuming my car (passenger side) at the local service station, well away from any road or marked laneway, and was hit on the open passenger door by someone driving a large RV. The insurance company said I may absorb some or all of the blame because my passenger door was open. It was not in a laneway but off to the side at the service stations far edge - I was not blocking anyone. My car was not moving.
Is there any truth to this???? It seems incredible to me that someone can hit a parked car's door and not be at fault. Especially as I was well off to the side by the fence at the perimeter of the lot.
Any thoughts? I am from BC Canada and deal with ICBC.
A: The only reason you might get stuck with the cost is because a parking area is not subject to normal rules of the road. However, if the police report shows them being at fault then you can get their insurance to pay for it.
Q: New York to San Francisco by RV, Summer 2009?
My girlfriend and I are travelling from New York to San Francisco by RV from Mid July to end of September 2009, around 87 days. I have a few questions and would appreciate if anyone can help us with the following:
Renting an RV:
I have checked the internet but the RV rental sites are annoying to deal with to get some idea of the cost per day. Does anyone have a good RV rental company and what should we pay per day all-in. I was thinking a large Class B, small Class A (might need space sometimes!). Any advice on best deals in New York city?
Parking:
does anyone know of an easy to use website with parking spots by state?
Any other information about RV's would be appreciated as I have not driven one before - insurance, getting water, propane, etc.
I have a full irish licence, will this be enough?

Q: I want to start my own transport business based in Tx....Can anybody give me some info. on how to do it right?
I would be starting out using my new diesel p/up and my 25' 14000# rated dovetail gooseneck. I want to be legal in Tx and the rest of the U.S. as well as obtain the proper commercial insurance coverage. I already have some "inside" contacts w/ an auto manufacturer, some oil/gas companies, boating and RV's, tractor dealerships and even some contacts in the rodeo/horse trailer business. I just want to do it right and not be one of these guys "rolling the dice" w/other peoples merchandise and lives by running illegal! Any help or advice would be appreciated!!! Thanks!!!
A: Trucking is an industry that has seen many great companies fail and become only memories. You are seeking a high risk venture, with profits (when there are profits) typically at about 2 cents per dollar revenue generated. Maintenance of equipment, insurance, replacement costs of equipment and employees are extremely high. Safety programs must be designed and implemented, employment taxes calculated and paid to the state and federal treasuries, and more.
As for illegal operators, trucking is regulated and when illegal operators are caught it ain't pretty. In 1994 we interviewed 76 drivers to get 6- amazingly the majority of applicants failed the drug test for employment. I hope they all get caught, I don't want an illegal/unsafe driver on the road with my wife, kids and grand-kids out there. And anyone who knows who they are and that they are illegal are condoning their behavior and enabling them to continue such if they fail to report them.
Old trucking firms like East TX Motor Freight comes to mind, Consolidated Freight another, as does Interstate Freight Systems and more- all were fine freight carriers. Complete Auto Transport, Auto Convoy (my old company) Dealers Transport (my father's old employer), WADE Auto Transport, Associated Auto Transport, Complete Auto Transport and more were all good auto transport companies, all now gone out of business.
If you are going to persist, hire on with an established trucking broker or firm, learn the ropes and save all the money you can- you'll need it to carry you thru the lean times when fuel costs soar and you can not pass thru fast enough the additional increased costs to maintain a profit and keep the business viable.
With the current state of affairs in the auto industry being what it is, everybody and their 4th cousin trying to be in the transport business now profits are squeezed even further. Having an "insider" will carry you so far, you have to have the funds to carry you the rest of the way.
Corporate finances change constantly. People change jobs, companies change employees, and you may be out in the drop of a hat as was my former employer, who, even thought they owned the land the auto maker was located on before the auto maker shuttled the plant and they were left high and dry. Nissan ran into hard times in the mid 1990's and rebid our traffic, never mind it was under a 5 yr contract; we lost the rebid. They did not honor their contract terms, and we were put out. As a result I lost a good job I had for several years.
Unless you can operate for a few years w/o an income, I'd do something else. Trucking is not for the faint or weak of finance.
Q: Purchasing motorhome (RV) as investment?
Has anyone got involved in motorhome ownership as an investment? Mgmt company looks after virtually everything to do with renting out the RV for a 40% cut of the revenues. Insurance is up to the owner.
A: Now is probably not a very good time for this undertaking. People are really scared about fuel costs.

Q: Tornado hit home and total loss ?
House will prob. be declared a total loss...what does that mean? If declared that term will the dwelling coverage of the insurance be paid out to the max as well as the contents? There also is a loss of use amount on my insurance policy, will that be paid out to me in full/I have to pay first and then get reimbursed. Not much can be done since the electric can't even be turned on till next month and many homes have a do not occupy sign posted...IT won't be a quick fix. CAn an upcoming purchase of a rv/5th wheel travel trailer be placed under a loss of use claim since living in a 1 room hotel is just difficult w/ a family? Will the insurance company make offers on total loss in terms of what will be paid out or is it an auto max payment of what the dwelling covers? Or does it go beyond the dwelling coverage if the fair market value is used since repairing it into what it used to be exceeds the dwelling coverage amount? thank you
A: When I had my total loss....
Allstate set an amount for me to rent a place (just like what I owned) and they gave that to me each month - and I had the option to rent a smaller place & pocket the rest (loss of use)
Dwelling should be rebuild exactly as it was minus you paying your deductible...if you had replacement cost.
If you had Actual Cash Value - they might cut you a check for the worth of your home - with depreciation....
Contents - They will cut a check...with depreciation for all the contents you can list/remember
and if you have replacement cost - as you replace the items & send in the receipts...they will reimburse you the different to pay your full replacement cost.
Good luck...remembering everything I owned was the biggest challenge!!! But you have 3 years to finish out your claim

Q: Three month road trip across the USA; what do I need?
My dream getaway is to take a lengthy road trip from Washington, D.C. (where I permanently reside) to San Francisco, to Miami, and back. I've already spent very long in thoroughly tracking routes to take, completely excluding major Interstates. I have prepared an itinerary that lasts nearly three months with many cities, towns, and sites.
I plan on taking either a car, or an RV, something to be comfortable in. I'm not sure if I should bring along other people, but it would help with gas prices and any tolls I may come along. I'm trying to leave space for spontaneous stops and random places to explore, so I haven't planned much beyond that. I also have the problem of financing it. I think it would cost so much money, even though I plan on sleeping either in the car, on a campground, in a tent, or in an RV, I do plan on staying overnight at certain destinations (Vegas, L.A., Dallas, Miami, Myrtle Beach, places where people would stay at a resort) to sleep on a bed and just have accommodations indoors for a couple of nights.
I imagine my entire trip to cost at least 8,000USD (excluding the cost of the RV) for supplies for the road, medical supplies, insurance, indoor stays, resorts and parks where there is a charge, pit stops, reserves for medical emergencies, outdoor gear, and entertainment.
What else should I be prepared for on the road or at destinations? I'm planning on seeing everything between DC and L.A. so you know that it includes a hefty lot. I want to be prepared. I also have a cat. Should I bring him with me if I have an RV? I don't trust anyone else to take care of him for months while I'm away, plus I want his company.
A: Just make sure you have access to extra cash in case something comes up... And I don't think you mentioned gas in the post, but surely you thought of it...
Q: Bankruptcy or debt consolidation?
I was divorced last fall, in Texas, where I still reside. My attorney refused to ask my x for disclosure, so I did not know that my x had $15,000 in credit card debt. The divorce papers say she's liable for debts she incurred from the day I walked out on her, and for all debts that are in her name, which these 3 revolving accounts are. But, she hasn't paid and yesterday, after getting turned down for credit, I checked my credit online and found out that two of her credit card companies have put charge-offs on my credit, a third one is about to, because she's 190 days past due on it, and she never paid the phone bill so Embarq has put a charge-off on my credit, too, for $150, which is the least of my worries, but my credit score is barely over 400 now. Everything else on my credit shows "paid on time/as agreed". I've never made a late payment on anything my whole life.
I'm considering bankruptcy, but I own two homes (one is a rent house, both are mobile homes). The industry I work in is winding down and I had planned on moving into the landlord business. I'd planned to purchase an RV park, not only as a new career, but as my only retirement income, as well. I'll be 50 years old in a few months. I don't have years left over to build more credit.
Suing my x for whatever she owes me will not do any good, because she refuses to work, doesn't have a job skill and will surely never pay me once I win in court.
My income is excellent, and I may make too much for Chapter 7. Also, one of my homes is in a mobile home park inside a city limits. My main home sits on 2 acres in a subdivision, outside of city limits. I'm concerned that if I file bankruptcy, I won't be able to keep both houses. I also have two cars. One is a junker that my X trashed and gave back to me while the divorce was still pending. I owe less than $2,000 on it. The other car is very nice, only 2 years old, and I owe a lot on it. I'm paying on all this, on time. My only concern is losing my homes and the good car.
Personally, I have no other bills besides the two house payments and the two car payments & their insurance. I have no revolving accounts.
Given my plans for retirement and my unsteady job security right now, which do you think I should do, file or consolidate just her bad bills and pay them off over time?
A: Greg...Chris C's post was a help....adding to that...first things first....the credit card debt...if it is not in your name, you need to find out if she put you on as an authorized user, if so, you are not responsible, if you signed on the dotted line to get the credit cards, yes you are responsible. If you did not sign, you need to contact each credit bureau and have them remove the incorrect information as in fact they are hurting your credit. As posted and as I mainly advise, bankruptcy should be your absolute LAST resort. If you make over the median income to qualify for a chapter 7, the only alternative is a chapter 13, which takes an allotted amount of money determined by the courts to pay for the debts. They would most likely have you sell the other home to pay for some debts, the chapter 13 plan runs either 3 or 5 years, depending on income. The payments are sent to the US Trustee of the bankruptcy court who then distributes the monies to the secured debts first, un secured last. While in a plan like this, anything financed you have to have the trustee approve. I'm not a fan of the chapter 13 as it leaves you with very little money to survive on. Debt consolidation, well...scam if you ask me..I'm not a fan of that either. As far as the vehicles, sell the beater and get the money to pay the debt if you are responsible for them. The trustees of the courts could make you sell the mobile home and pay off debts with the money. Best advise, you could contact a bankruptcy attorney to find out what your options are, most will see you free the first consult. You can check in www.cccs.org..which is a consumer credit counseling that I have heard is excellent. What you need to keep in mind...A bankruptcy stays on your credit report for 10 years, the debts for 7...If the debts are not paid, they can garnish wages and or bank accounts up to 100%...sounds like you have done well, and know how to pay your bills and are just overwhelmed with knowing she has left you with this debt. Prior work as a professional magician, salesman at promotional products company. Customers were Hewlett Packard, Sapp Bros. Truck Stops, Central Hockey League, and many more. Here are this year's winners:
5th Place (tie):
Kathleen Robertson of Austin, Texas, was awarded $80,000. by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The owners of the store were understandably surprised at the verdict, considering the misbehaving little toddler was Ms. Robertson's son.
5th Place (tie):
19-year-old Carl Truman of Los Angeles won $74,000 and medical
expenses when his neighbor ran over his hand with a Honda Accord. Mr. Truman apparently didn't notice there was someone at the wheel of the car when he was trying to steal his neighbor's hubcaps.
5th Place (tie):
Terrence Dickson of Bristol, Pennsylvania, was leaving a house he had just finished robbing by way of the garage. He was not able to get the garage door to go up since the automatic door opener was
malfunctioning. He couldn't re-enter the house because the door
connecting the house and garage locked when he pulled it shut. The family was on vacation, and Mr. Dickson found himself locked in the garage for eight days. He subsisted on a case of Pepsi he found, and a large bag of dry dog food. He sued the homeowner's insurance claiming the situation caused him undue mental anguish. The jury agreed, to the tune of $500,000. In my opinion this is so outrageous that it should have been 2nd Place!
4th Place:
Jerry Williams of Little Rock, Arkansas, was awarded $14,500. and medical expenses after being bitten on the buttocks by his next door neighbor's beagle. The beagle was on a chain in its owner's fenced yard. The award was less than sought because the jury felt the dog might have been just a little provoked at the time by Mr. Williams who had climbed over the fence into the yard and was shooting it repeatedly with a pellet gun.
3rd Place:
A Philadelphia restaurant was ordered to pay Amber Carson of Lancaster, Pennsylvania, $113,500. after she slipped on a soft drink and broke her coccyx (tailbone). The beverage was on the floor because Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument.
2ndPlace:
Kara Walton of Claymont, Delaware, successfully sued the owner of a night club in a neighboring city when she fell from the bathroom window to the floor and knocked out her two front teeth. This occurred while Ms. Walton was trying to sneak through the window in the ladies room to avoid paying the $3.50 cover charge . She was awarded $12,000 and dental expenses
1st Place:
This year's runaway winner was Mrs. Merv Grazinski of Oklahoma City, Oklahoma. Mrs. Grazinski purchased a brand new 32-foot Winnebago motor home. On her first trip home, (from an OU football game), having driven onto the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go into the back & make herself a sandwich. Not surprisingly, the RV left the freeway, crashed and overturned. Mrs. Grazinski sued Winnebago for not advising her in the owner's manual that she couldn't actually do this. The jury awarded her $1,750,000. plus a new motor home. The company actually changed their manuals on the basis of this suit, just in case there were any other complete idiots around.
