A: Typically, insurance rates will vary from State to State and can even vary by ZIPCODE! It also will depend on the type of car/truck, coverages, limits of liability, and driving record. The best thing to do is call a LOCAL independent agent. Don't go across town, or to some other city - look for someone CLOSE. Just look in the phone book for the PIA or Big I (Trusted Choice) logos and you will find a professional licensed agent that will be able to help you solve your insurance problems, and give you rate comparisons of several different companies.
An independent insurance agent will normally have a dozen different companies and if he cannot help you, he should be networked with other local agents that can.
Most of the replies on this site say "go to this on-line carrier or that on-line carrier or that 1-800 number" but I'm sure that when you do, you will find some impersonal computer user with a script to work from and you won't be able to talk with the same person every time you have a problem!

I went back 6 weeks later (today) for a followup and the pain has stopped but the popping/grinding has not.I will have the arthritis for the rest of my life.The insurance company wants to settle and I dont know a monetary $ value to tell them.

My medical bills are about $2200-$3000 and I also purchased some weights to lift as suggested by my specialist to ease the pain. I forgot to add the damage to the vehicle was about $9000 and the frame was bent but the vehicle wasnt totaled cause the bluebook was about $18,000.
What I really want to know is how much is pain and suffering actually worth? I was in a lot of pain and was drugged up for like 2 weeks and didnt feel like doing anything. I don't know a value for something like that. I just want to know something fair and nothing money. They offered only $1000 and that don't seem fair since the arthritis will probably give me problems later on down the road.

A: First, I have to preface my comments by saying this is not personal and I hope you get everything you deserve in your settlment. My comments are based on my experience as a long time adjustor and I'll identify some of your strengths and weakness( in my opinion) based on the info you've provided.I have to address the osteoarthritis (OA) injury. I am not a doctor but would emphatically disagree that your current OA is caused by the loss. I'm not sure there is anyway that OA manifests iteself in six weeks. Could your injury lead to OA? Yes, but I don't think anyone can say it definately will...your chances only increase with trauma to the joint. That is a weakness of your case as literature would support that opinion. If your doctor says otherwise, God bless him and pound that into the adjustors head but you'll want to get the dictated medical records from all your treating providers to know exactly what is noted not just what they told you verbally. It could vary. Now, your age is in your favor but what I would look at is your occupation. Are you in a position requiring manual labor, overhead work, repetative use of the shoulder, etc. do you have a prior medical condition? Those are things that could lead to OA as well. However, at 22, it's not that common and trauma induced OA would be more common...just not after 6 weeks...OA does not quickly set in. This is a degenerative condition that takes time to develop.
What's it all worth? That's tough. Much of has to do with how you present and your witness qualifications vs. the other driver. Was the other driver drunk or some other aggravating factor? I would say your claim is worth your bills plus 1000-2000 on top of that. It's likely you were diagnosed with a bone bruise (which hurt like hell) and/or a shoulder soft tissue sprain/strain. You stated the pain has stopped so you're entitled to 6 weeks or so of pain and suffering. As for the grinding, that is called crepitus and can be a symptom of OA. I'm really curios what your occupation is though, and how that may/may not be a factor.
I don't see an attorney making a bunch of money for you on this one but you'll have to decide that. Too many people push everyone to attorneys...especially on this website. Attorneys generally take 1/3 of a settlement meaning you'll have to recover 50% more on a settlement with the atty to net the same amount and that just doesn't happen that often and when it does, it's because the atty brought something to light that the insurance company may not have been aware of.

This is what confuses me... I wasn't in any auto accident at all. Just went to the emergency room for an animal bite. They sent me a EOB. I paid the bill for the copay. Then they sent me this one again. Could this just be a mistake then?
A: When a hospital bills a claim for you, there's a numeric code used to indicate a type of accidental injury and the date of the injury.
I suspect one of 2 things happened here...1) the hospital made a typo on the 2 digit code, and it looks like "auto accident" vs. what actually happened in your situation. or 2) your insurance company saw the claim coded as an "accidental injury" and mistakenly assumed that meant auto accident.
I would suggest that you call your insurance company and advise them that there was no auto accident. If you explain what happened, they should likely be able to resolve the issue over the phone.
Aside from the hassle of making the phone call, it should be a relatively simple issue for you to fix.

A: I'm a claims adjuster and I'll be honest with you.
DON'T get a lawyer.
First of all, osteoarthritis is not something that was caused by an accident. It may have been aggravated by the collision, but osteoarthritis is by nature a degenerative condition. This means it would be caused by normal wear and tear on the body and generally accompanies aging.
Secondly, you should at the VERY least see what the insurance company has to offer you before retaining an attorney. Often, people end up with the same (if not less) than they would have gotten directly from the insurance company. A reputable insurance company is going to evaluate your claim based on its merits, and pay a fair amount based on your injury and your venue. Having an attorney WILL NOT change the nature of your injury, or the venue you're in. All it will do is pay for another ad on daytime television to try to lure unsuspecting people into giving up one third of their insurance money.
The people who say "get an attorney and fight it out in court" don't know the game, and don't know that more than 99% of attorney represented claims don't go to court... because your attorney will lose, and you may end up with nothing. But this is all a tangent that you didn't even ask about, and more a response to the irritating people who think that getting an attorney will somehow get them more money.
Anyway, although you've provided more information than most people do when asking your sort of question, you'd need to tell us the county and state you reside in for any of us to have any idea how much your claim is worth.
EDIT: I'm sorry if I sounded harsh, it wasn't even really directed at you. But something like osteoarthritis is not something I'd expect to be causally related to an accident.
And again, without knowing where you are, it's hard to say. Jurisdiction has a lot to do with how much your claim is worth... the insurance company should offer you something, you shouldn't have to come up with a figure on your own. You can probably negotiate up somewhat from their initial offer.

A: You would not sue the insurance company - because they are not the negligent party in this situation. If you were to sue the insurance company, they would file a motion to dismiss the action because they were not a party to the suit. You would need to file suit against the tortfeasor (the wrong-doer). You might have better luck pursuing the claim against the other party's policy first - and try to negotiate with the insurance company. Once you file suit, there are many costs associated with it, as well as different forms of investigation that are extremely time consuming - and also may require you to get the assistance of an attorney. Once that happens, they will take a 25-40% cut off the top of your settlement.

A: The other insurance is only responsible for the actual cash value of the vehicle, not your loan balance. If there is GAP insurance it should cover the difference b/w the ACV and the loan less late payments/fees.
The cop is right...you failed to yield. Just b/c you get a green arrow doesn't give you the option to just go enter an intersection w/o yielding to other cars that may already be in the intersection. You have to look first prior to entering, and even if it's clear, you still have a duty to maintain a proper lookout & take reasonable & prudent steps to avoid an accident, like honk, stop, etc. If I recall my Texas law correctly, it is a modified negligence state, which means if you are found 51% or more at fault for an accident you can not recover. If you're under the 51% threshold, you recover up to your negligent free percentage. Your failure to yield may reduce your overall settlement, both for your property damage and your injury claim.
If you have insurance go through your own insurance company...that's why you have it. Let the carriers hash it out b/w each other.

I have AARP insurance known as The Hartford and turned 60 in November of 2006. Upon my renewal in February of 2007, without any notice, my premium went up $166.00 a year. I have had no tickets or accidents and made no claims in the 10+ years of having this insurance. I thought AARP was designed for people over 50 years of age. When I called them, I was told that all insurances raise their premiums when people turn 60.
A: They lied to you. Some companies drop insurance rates when you are 60. Most companies look more at your driving record and claims rather than your age. After years of being an AARP member I will not renew this time because they no longer represent the people over 50.

While the rear left brake axle was being repaired, the front left door hinge became loose. The repair guy forced the door open and left a large dent in my front left quarter pannel. A: They will if they pay out. If you have full coverage and the other guy has no insurance, you in turn go to your carrier for restitution. They then go after the other guy to recover their loss and your deductible.
II was the middle car of a 3 car wreck last November, and that is how it worked. I live in TN the wreck occurred in GA, so GA law also was a consideration in the settlement.
You also must consider that if the damage exceeded a certain dollar threshold, It will be reported to the motor vehicle department and on your title as having been in an accident. That will devalue your car as a resale or trade-in, so you also need compensation for the loss in value. I was paid $950.00 as loss in value on top of the repair bill for my 2006 Jeep Liberty Limited CRD w/3,600 miles on it.
I went back to the selling dealer for his opinion; he devalued the Jeep $5,000.00, it was only 5 weeks old. State Farm hid behind a ruling on another GA case and would only pay $950.00 per a formula they were able to get thru the court in GA. Again since the accident occurred in GA, GA laws governed. But that does not make it morally right for State Farm to inadequately compensate for their insured's harm to my property.
The cost to me to fight it would exceed $5,000.00 and State Farm knew it. It is true, there is no honor among thieves.
My insurance company, SafeCo instructed me to take the car to a shop, if State Farm failed to take care of me right away they'd open a claim. I'd have to cover the deductible but they'd recover it for me. In the end State Farm came across as my per diem for the loss of a 4X4 Jeep use (I am a real estate broker/developer) was not going to be pretty for them, it is how I make my living and required the 4X4 to go over and thru job sites (mobile office).
